Risk Management

• What are the conveyancer’s obligations to the client?;
• Who is the client?;
• Keeping the client informed;
• Getting and documenting instructions;
• Maintaining file notes;
• Third parties (confidentiality, authority, family, representatives);
• Checking all contractual documents, vendor statements, liabilities;
• If any doubt arises, seek help;
• Professional advisers (extent of conveyancer’s competence & PII issues, who should seek advice, referrals to particular advisers);
• The check search;
• Conflicts of interest;
• Acting for both parties (incl statutory requirements, advice, disclosure, ceasing to act);
• Spotting and dealing with problems (identification, mental capacity, authority, fraud); and
• Professional indemnity insurance and notification.
