On 28 July 2008 the Real Estate Industry Reform legislation became operative with two exceptions. Whilst it primarily focuses on the activities of agents and auctioneers, it substantially affects the rights, duties and obligations of vendors and purchasers – hence it has a major impact on what conveyancers do.
The legislation is quite complex and convoluted. As a service to conveyancers and in the absence of similar adequate materials from any source, we prepared and circulated an 8 page Bulletin that highlighted important aspects of the legislation from a conveyancer’s viewpoint and suggested courses of action to be taken in various circumstances.
As the days pass, more issues are raised and examined in greater detail. New meanings are suggested in the light of particular circumstances and the deliberate and accidental interrelationship between provisions are still being unravelled and understood.
