New Legislation: unfair contract terms

The Trade Practices Amendment (Australian Consumer Law) Act (No. 1) 2010s has been passed. This Act renders void unfair terms in standard-form consumer contracts. A contract can however, continue to bind the parties to the extent the contract can operate without the unfair term.

Contracts caught by the legislation include a contract for the sale or grant of an interest in land to an individual who acquires it wholly or predominantly for personal, domestic or household use or consumption (Trade Practices Act 1974 (Cth) Sch 2, Part 2,s2(3))
